French Oak Floors Terms and Conditions

1. Definitions and Scope

1.1 "Company" refers to French Oak Floors.

1.2 "Customer" denotes any individual or entity purchasing the Company’s products or services.

1.3 "Goods" encompasses all engineered timber flooring products and associated accessories provided by the Company.

1.4 "Services" refers to installation, customisation, and other professional engagements rendered by the Company.

2. Orders and Payments

2.1 An order is deemed confirmed upon receipt of a deposit as per payment terms specified in the quotation. 2.2 For supply-only orders, the remaining balance is required prior to delivery. Failure to meet payment deadlines may result in storage fees or rescheduling costs.

2.3 Quoted prices are valid for 14 days and are subject to potential adjustments based on market variables such as raw material costs and currency fluctuations.

2.4 All measurements, quantities, and pricing are preliminary approximations. The Company reserves the right to conduct site measurements prior to or during installation, with any variances from initial plans supplied to French Oak Floors adjusted in the final invoice. Please note that even site measurements conducted by the Company are estimates, and adjustments may still be required based on unforeseen factors or on-site conditions.

2.5 Stock Progress Payment: Should project timelines extend beyond initial expectations, the Company may require full payment for materials to ensure continued stock reservation.

2.6 Payments made by credit card will incur a 1% surcharge.

3. Delivery and Risk

3.1 Delivery timelines are approximate and may be influenced by factors beyond the Company’s control, including logistical disruptions.

3.2 Risk of loss or damage transfers to the Customer upon delivery. Ownership of the Goods remains with the Company until full payment is completed.

3.3 The Customer must notify the Company of delivery requirements at least seven (7) days prior to the intended deliverydate. 3.5 Any refusal or delay in accepting delivery may result in additional charges, including storage fees and re-delivery costs.

4. Installation

4.1 Site Conditions: The Customer must guarantee that the installation site is clean, accessible, and adequately prepared. This includes ensuring the area is free of obstructions and debris to allow seamless work.

4.2 Levelling and Subfloor Preparation: If levelling or subfloor preparation is required and the Customer declines to proceed with this essential work, the Company will not be liable for any future issues arising from the installation. Additionally, the warranty for the flooring will be voided in such cases. Refusal to perform levelling may also result in additional fees due to the increased complexity and difficulty of the installation. 4.3 Installation services must adhere to the Company’s guidelines. The Company disclaims liability for defects arising from improper installation by unauthorised personnel.

4.4 Alterations or inadequate maintenance post-installation void warranty coverage.

4.5 The Company is not responsible for ensuring that stair structure heights comply with relevant building codes or standards. Any non-compliance issues must be addressed by the builder prior to the installation of flooring on stairs.

4.6 Cancellations or rescheduling of installations within sufficient notice may incur supplementary fees.

5. Warranty

5.1 The Company offers a 25-year warranty covering manufacturing defects, delamination, and structural integrity under standard residential use conditions.

5.2 Exclusions

  • Damage resulting from improper maintenance, environmental conditions, or moisture exposure outside recommended ranges.
  • Surface issues such as scratches, dents, or marks from improper use or heavy objects.
  • Natural ageing phenomena, including UV-induced fading and colour changes.
  • Defects due to non-compliance with installation or maintenance protocols.

5.3 Warranty claims require submission of proof of purchase,a detailed issue description, and photographic documentation for evaluation.

6. Cancellations and Returns

6.1 Orders cancelled prior to dispatch are subject to a 15% restocking fee.

6.2 Returns are accepted exclusively for unused and unopened products in their original packaging. Customised or special-order items are non-refundable.

7. Liability

7.1 The Company is not liable for indirect, incidental, or consequential damages arising from product use or installation.

7.2 The Customer’s remedies are limited to repair, replacement, or refund, as determined at the Company’s discretion.

8. Governing Law

8.1 These Terms and Conditions are governed by and construedin accordance with the laws of the state of Victoria, Australia.

8.2 Any disputes shall be resolved through arbitration,consistent with the principles outlined in Australian Consumer Law.
